The Temporary Skill Shortage Visa –Subclass 482 (“TSS”)

The Temporary Skill Shortage Visa –Subclass 482 (“TSS”) is a temporary visa that allows an employer to sponsor a suitably skilled worker from outside Australia, to take up a position in Australia, if there is no suitable Australian candidate.

Depending on the occupation or skills, this visa is available for the short term (generally two years to live, work and study in Australia); or for the medium term (generally 4 years). If eligible, you may be able to apply for permanent residency.

You can also apply for this visa under a labour agreement stream. This allows you to live and work in Australia for up to 4 years. Labour agreements are developed between the Australian Government (represented by the Department of Home Affairs) and employers. Labour agreements are in place for the following industries: Dairy; Fish; Meat; Minister of Religion; On-Hire industry; Pork; Restaurants (Fine Dining); Advertising; and Horticulture.

Skilled Employer Sponsored Regional Sponsored Visa Australia

Regional Labour and Skill Shortages

Regional employers can address labour shortages in their region by sponsoring skilled workers to stay and work in regional Australia through the Skilled Employer Sponsored Regional Sponsored Visa (subclass 494). This is done through employer sponsorship (stay for 5 years). You may be able to apply for permanent residency after 3 years in the designated regional area.

You may also apply for this visa under a labour agreement scheme. This stream is for skilled workers nominated by employers who have a labour agreement. These agreements are
developed between the Australian government and employers. Labour agreements are in place for the following industries: Dairy; Fish; Meat; Minister of Religion; On-Hire industry; Pork; Restaurants (Fine Dining); Advertising; and Horticulture.

Under this stream, you can stay for 5 years and work in designated regional area. If eligible, apply for permanent residence after 3 years from the time your visa is granted.

Employer Nomination Visa

The Employer (Nomination) Scheme (subclass186) lets skilled workers, who are nominated by their employer, to live, work and study in Australia permanently. It applies to particular (listed) occupations, or to occupations that are part of labour agreements.

You must be nominated by an Australian employer; have relevant work skills and satisfy certain requirements. Your application can be made inside or outside Australia. You can include your family unit (as defined) in your application.

This Visa lets nominated skilled workers live and work in Australia as permanent residents, and if eligible, apply for Australian Citizenship.

To apply for this Visa you submit an “expression of interest” to the Department of Home Affairs. Following this, if successful, you will be nominated by Australian State or Territory government organisation and invited to apply for this visa. You must attain a certain level of points to qualify. You can include members of your family unit (as defined) in the application.

Skilled Regional (Provisional) Visa (subclass 491)

This is a “points-based” visa for skilled people who meet the visa criteria and are nominated by an Australian State or Territory government organisation to live and work in regional Australia. Submit an “expression of interest” to get an estimate of your points, and, following this, if successful, a governmental nomination. As an alternative to a government nomination, you may be able to be sponsored by an eligible relative.

Generally this visa allows you to live and work in a regional area for 5 years. You can apply for permanent residency after 3 years in Australia.

Temporary Graduate Visa subclass 485

There are three streams for this:

  1. Graduate Work Stream. If you are an international student who has recently graduated with skills and qualifications relevant to specific occupations in Australia, you may apply for a temporary visa to let you work and study in Australia.
  2. Post-Study Work Stream. If you are an international student and you recently graduated with a degree from an Australian institution, you may be able to apply for a visa that enables you to live, work and study in Australia, temporarily.
  3. Second Post Study Work Stream. This visa is for holders of a first Temporary Graduate visa in the post-study work stream who graduated with a degree from an Australian institution located in a regional area. It lets you live, work and study in Australia, temporarily.
Other Specific Work and Training Visas

A Training Visa (subclass 407)

This Visa allows you to take part in workplace based occupational training in Australia. It is a temporary visa and you can generally stay for up to 2 years. You must have a sponsor, be nominated (unless your sponsor is a Commonwealth Government agency, and then you need an invitation) and meet certain other requirements.

Temporary Specialised Work Visa (subclass 400)

This visa lets you do short term, highly specialised work in Australia. It is generally for a short stay of up to 6 months. You can include members of your family unit, as defined, in the application.
